Cue Sheet Terms of Use
Draft for review. Have a lawyer check before publishing.
Cue Sheet is a desktop show-control app for community and school theatre, sold by Ethan Entermedia, LLC ("we," "us"). By installing or using Cue Sheet you agree to these terms. If you don't agree, don't use it.
1. License
When you buy a subscription, we grant you a non-exclusive, non-transferable license to use Cue Sheet. One subscription covers 2 computers. Extra computers are $49 per year each. You may use Cue Sheet personally or for your school, theatre or organization.
You may not sell, rent, sublicense or redistribute the app or your license key. You may not reverse engineer, decompile or copy the app, except where the law gives you that right despite this term.
Cue Sheet runs on Mac computers with macOS 13 or newer. Windows and Linux versions are not sold yet. Phones and tablets join the booth computer over the local network.
2. Free trial
New customers get a 14-day free trial. The trial needs no card.
3. Payments, renewal and cancellation
Cue Sheet costs $19 per month or $199 per year, shown at checkout. Our payment provider, Lemon Squeezy, is the merchant of record. It handles payment, receipts, sales tax and refunds under its own terms. Send refund requests to the payment provider.
Your subscription renews automatically at the end of each billing period until you cancel. You can cancel anytime, and manage your subscription, on Lemon Squeezy's customer page. The link is in your receipt email. Canceling stops future charges. It does not refund the current period unless the payment provider's policy says so.
4. If your subscription lapses
After a trial or subscription ends, everything keeps working for 7 days. After that, editing, new shows, script import, sound uploads and adding devices lock until you renew. Existing shows still open and run. GO, lighting and video cues, sound, and devices that already joined keep working.
A lock never starts in the middle of a running show. It takes effect the next time Cue Sheet is opened.
Your show data stays on your computer. A lapse never deletes it.
5. License checks and updates
Activating a license key needs the internet once, to check the key with Lemon Squeezy. After that, Cue Sheet checks your license when it opens, and quietly once a day while online. It runs without internet, including reading scanned scripts, but it needs to reach the internet at least once every 30 days. After 30 days without a check, the 7-day period in section 4 starts, then editing locks. A check never stops a show that is running.
The app checks once a day for new versions. We may release updates to fix problems or add features. See the Privacy Policy for what these checks send.
6. Your content
You own your scripts, cues, sound files and other show content. We claim no rights in it. It stays on your computer, in Documents > Cue Sheet.
You are responsible for having the rights to anything you import, including licensed plays, scripts and sound files. Cue Sheet doesn't give you permission to perform or play any work. Get those licenses from the rights holders.
7. Third-party components
Cue Sheet includes open-source software, including pdf.js and Tesseract.js (Apache 2.0), a QR code library (MIT), the Bun runtime (MIT) and fonts under the SIL Open Font License. These components stay under their own licenses, listed in THIRD-PARTY-NOTICES.
8. No warranty
Cue Sheet is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We don't promise it will run without interruption or errors.
Cue Sheet is used in live performance. You are responsible for having a backup plan for every show, such as a manual cue list, a second computer or a person ready to take over.
9. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, including lost revenue, canceled or disrupted performances, or lost data. Our total liability for any claim related to Cue Sheet is limited to the fees you paid us in the 12 months before the claim arose.
10. Termination [Optional, lawyer to confirm]
You can stop using Cue Sheet at any time. We may end your license if you break these terms, for example by reselling the app. If we do, you must stop using the app and delete your copies. Sections 6 through 9 and 11 survive termination.
11. Governing law
These terms are governed by the laws of North Carolina, without regard to its conflict-of-law rules.
12. Changes to these terms
We may change these terms by posting the new version on ethanentermedia.net with an updated date. [Lawyer: confirm whether to promise advance notice of material changes.]
